Terms of Service

1. Basic provisions

This document, referred to as the "Terms of Service for PilotWizard.ai" (hereinafter referred to as the "Terms"), outlines the legal agreement between PilotWizard (also referred to as the "Service," "PilotWizard," or "PilotWizard service") and you, the user (also referred to as "customer," "user," "member," or "you"). When we say "we," "us", "our," and "PilotWizard," we are referring to PilotWizard.ai

Pilot Wizard LLC also operates under the following DBAs (Doing Business As):

All references to Pilot Wizard LLC, PilotWizard, or the Service in these Terms also apply to the above-listed DBAs and their respective services.

PilotWizard Inc. offers the PilotWizard services to you under the conditions stipulated in these Terms. These Terms, along with our Privacy Policy and Cookie Statement, govern your use of the PilotWizard services. We reserve the right to amend these Terms at any time. If changes are material, we will provide reasonable notice via email or by posting an update on our website prior to the changes taking effect. By accessing or using the PilotWizard service in any capacity, you consent to be bound by these Terms, on behalf of yourself or the entity you represent. These Terms remain binding for as long as you utilize the Service or any data derived from the Service. Your use of the Service confirms that you possess the legal right, authority, and capacity to agree to these Terms on your behalf or on behalf of the entity you represent. You declare that you are of legal age to enter into a binding contract or, if you are not, that you have obtained the necessary consent from your parent or guardian who has agreed to these Terms on your behalf. If you are accepting these Terms on behalf of an organization or entity, you affirm that you are authorized to bind that organization or entity to these Terms (references to “you” and “your” in these Terms, except in this clause, refer to that organization or entity).

Should you disagree with any of the terms herein, you must not access or use the PilotWizard service, and our administration reserves the right to restrict your access to the Service.

Services provided

PilotWizard grants users access to a suite of specialized services designed to enhance digital communication and management capabilities. These services include:

  • Communication Tools: Access to email, SMS, Web Push, and chatbot campaigns for platforms like Facebook, Instagram, and WhatsApp.
  • SMTP and Verification Services: Provision of SMTP services and an email verification tool to ensure the reliability and accuracy of your email communications.
  • Landing Pages: PilotWizard offers a paid service for creating tailored Landing Pages, utilizing cutting-edge tools to enhance your online visibility and campaign impact. This option allows users to effectively elevate their digital footprint and engage their audience more dynamically.
  • CRM System: A robust CRM system is available to streamline sales processes and manage communication channels effectively

User Rights and Access:

  • Account Management:Users can register for an account specific to their service needs, with the flexibility to alter billing plans or delete the account as necessary.
  • Technical Support: Users are entitled to technical support to assist with any service-related issues.
  • Educational Resources: Access to a variety of learning materials to help users maximize the use of PilotWizard services.
  • Additional Services: Users may request extra services, which are available for an additional fee.
  • Confidentiality Assurance: PilotWizard guarantees the confidentiality of the user's personal information and any mailing lists uploaded to their account.

These provisions are designed to provide a comprehensive, secure, and effective experience for all users of PilotWizard services.

User registration

By “account,” the user’s account on his/her personal Dashboard on PilotWizard is meant. Registration is carried out on the official website at the Sign Uppage.

During the registration process, users are required to provide personal information including their name, email address, and telephone number, and to create a password. This password will be used for future access to their account. Users must not share their username and password with others. The responsibility for maintaining the security of this login information rests solely with the user.

All personal data collected during registration is protected under the PilotWizard Terms of Service and Privacy Policy. This information may be used by service employees to contact the user in accordance with the Privacy Policy.

It is imperative that users provide accurate and valid information during registration. Accounts created with false or misleading information may be suspended. Service employees may request verification of personal details to confirm their authenticity.

Payment for services

Upon completion of the registration process, every customer becomes an official user of the PilotWizard service. The service offers various billing plans, and users have the flexibility to switch to a more suitable plan at any time.

Payment of any billing plan or additional service shall take the form of 100% prepayment. The payment procedure is as follows:

  • Order Placement: Users place orders either through the official PilotWizard website or within their service dashboard.
  • Billing: The service administration will issue an invoice for payment. If the invoice is not paid within the specified period, it may be canceled.
  • Payment Methods: Payments must be made exclusively through the methods approved by PilotWizard, such as PayPal or credit card.
  • Funds Crediting: Payments made electronically are reflected in the user’s account. Access to any additional services purchased will also be granted after the payment is received.

Refunds and Subscriptions:

  • Refund Policy: Users have 30 days from the payment date to request a refund for any unused services. A valid reason must be provided for such a request.
  • Subscription Renewals: Monthly subscriptions automatically renew. Users can deactivate this feature at any time through their personal account settings.
  • Plan Upgrades: Plan upgrades can be made at any time via the user personal account settings or via email to the PilotWizard support team.

2. The User’s Account

Account Creation

After going through the registration process, an account is automatically created for the user. All actions regarding emails, billing plans, and payment shall from this moment be carried out through the account.

Personal Account Information

When registering, the user provides a personal email address which will be used as a username, and a personal password for accessing the Service. This information is strictly confidential, kept in an encrypted form, and will not be transmitted to third parties.

The Service additionally asks that the user fill in an expanded form with personal data that the customer can use when working with emails (“variable substitution”). Data provided in filling this form is also subject to the Privacy Policy.

Account Management

Users manage their activities directly within their accounts, including sending emails, viewing statistics, changing billing plans, verifying email addresses, and creating campaign templates. Users also upload recipient details such as email addresses and phone numbers to their accounts to build address books.

All such uploaded information is considered the property of the user and is treated as confidential, safeguarded by the Privacy Policy of the PilotWizard service.

The service administration reserves the right to monitor user activities and may temporarily block accounts suspected of sending spam, as per the Anti-Spam Policy agreed upon during account registration.

Account Deletion

Users can request account deletion at any time. Remaining funds in the account are generally non-refundable, except under special circumstances warranting a refund. Decisions on refunds are guided by the Anti-Spam Policy. Funds are not returned to users whose accounts are blocked due to violations of the Anti-Spam Policy.

PilotWizard reserves the right to suspend or terminate accounts at any time, with or without cause. Upon termination, users acknowledge that PilotWizard may permanently delete the account and all associated data. Furthermore, the same username will not be available for any future accounts.

3. Marketing Campaigns

PilotWizard offers a comprehensive suite of services including email, SMS, Web Push, chatbot campaigns for platforms such as Facebook, Instagram, and WhatsApp, along with SMTP and email verification services. Additionally, it provides Landing Pages and a CRM system for efficient sales process and communication channel management. These services are accessible through the user's personal dashboard.

Creating Marketing Campaigns

Users can design their own campaign communications by selecting options provided by the Service, uploading images, and crafting text. Alternatively, users may opt to pay PilotWizard to manage various marketing campaigns. Users are fully responsible for the content of their mailings, which must adhere to the Service’s Anti-Spam Policy. Failure to comply may result in temporary suspension of the user’s account until the circumstances are clarified.

Mailing Lists

Users are permitted to send communications only to recipients who have explicitly consented to receive them. The Service may request proof of this consent.

Prior to campaign dispatch, users can utilize the PilotWizard email verifier to check the validity of mailing lists and filter out invalid or non-existent email addresses. This service is informational; complete accuracy of the verification results is not guaranteed. Validated email addresses enhance the likelihood of campaign approval but do not assure it, as compliance with the Anti-Spam Policy is also required. Sending to "invalid" emails is prohibited.

Users must ensure an unsubscribe option is available in every communication and honor opt-out requests promptly. It is strictly forbidden to use subscriber bases obtained illegally or to distribute spam via the PilotWizard service.

Sending Marketing Campaigns

Campaigns are scheduled for dispatch through the Service, undergoing a moderation process to verify the authenticity of the subscriber base and the compliance of the content with the Anti-Spam Policy.

Moderation and dispatch are completed within 24 hours. If a campaign fails moderation, the user will be informed, and appropriate actions will be taken to address the issue or potentially block the user’s account. Each email must include an unsubscribe link, which cannot be concealed or omitted. If absent, the Service will insert a standard unsubscribe link.

Each email will contain an unsubscribe link, i.e. a way for subscribers to opt out of receiving further communications. The link cannot be removed or hidden. If the user does not insert an unsubscribe link into an email, the Service will automatically add its own standard link to the email, and the user’s actions shall be construed as being contrary to the Terms of Service.

Delivery of Marketing Campaigns

The delivery timing of campaigns can vary due to several factors. PilotWizard is not liable for undelivered messages or delays, which may occur for reasons such as:

  • The recipient's device being off or out of coverage,
  • Use of greylisting or rejection of emails tagged as spam by recipient's mail service,
  • Full inboxes or technical issues with the recipient's email server,
  • The recipient’s mail server rejects the email due to the presence in the email of blocked links (i.e. URLs in a blacklist or graylist),
  • Environmental or other force majeure events affecting the operation of the Service's infrastructure. These conditions or circumstances include, but are not limited to, natural disasters, changes to law or regulations, embargoes, war, terrorist acts, riots, fires, earthquakes, nuclear accidents, floods, strikes, power blackouts, volcanic action, unusually severe weather conditions, and acts of hackers or third-party internet service providers.

Web Push Notifications

PilotWizard provides the basic functions of web push notifications for free if your database is less than 10,000 subscribers.

From now on, if you have not used the web push service for a long time, we can delete the record about your website and subscribers. This can happen if there have been NO new subscriptions and NO notifications during the last 6 months.

4. Additional Services

The array of additional services includes services that are not provided by the Service’s basic functionality.

The additional services of PilotWizard include:

  • Design Services: Custom email layouts designed by a professional designer to enhance brand consistency.
  • Email Address Verification: Ensures the accuracy and validity of email lists.
  • Website and Landing Page Creation: Design and publication of websites and landing pages tailored to your needs.
  • CRM System Management: Advanced tools for managing sales processes and communication channels.
  • Ad Campaign Video and Promotion: Design and development of video ads for social media platforms.

These services incur additional charges beyond the activation of a pricing plan. Terms specific to each additional service are available on the company’s official website or within the detailed documentation accessible through your PilotWizard account.

5. Third-Party Services Disclaimer

PilotWizard may integrate with or provide access to third-party services and applications (such as Stripe, OpenAI, and other integration partners). Please note that any third-party integrations are subject to their own terms of service, privacy policies, and other legal agreements. PilotWizard does not control and is not responsible for the practices of these third-party services.

By using these third-party integrations through PilotWizard, you acknowledge that:

  • You are subject to the terms and policies of those third-party services in addition to PilotWizard's Terms of Service
  • PilotWizard is not responsible for any loss, damage, or other liability arising from your use of these third-party services
  • The availability, accuracy, and functionality of third-party integrations may change without notice

We recommend reviewing the terms of service and privacy policies of any third-party services before using them in conjunction with PilotWizard.

6. Obligations of PilotWizard Users

Users are required to:

  • Maintain confidentiality of their username and password and prevent unauthorized account access.
  • Provide accurate personal data and ensure the validity of all information uploaded to their account.
  • Abstain from using purchased or illegally obtained subscriber bases.
  • Avoid using the platform for sending spam.
  • Comply with the Anti-Spam Policy and the Terms of Service. Violations may lead to suspension or deletion of the account.
  • Allow recipients to unsubscribe from emails at any time.
  • Refrain from using rude or obscene language when interacting with service staff.

Disagreement with the Terms of Service will result in denial of service. Users must own or have rights to all materials in their emails and comply with applicable laws and regulations. Data collection and campaign execution must adhere to declared data use practices and obtain necessary consents.

7. Obligations of PilotWizard

PilotWizard is committed to:

  • Providing access to the online platform post-registration
  • Offering necessary functionality for creating and sending email, SMS, Web Push, and chatbot campaigns.
  • Ensuring continuous access to the platform using the provided credentials.
  • Presenting a selection of billing plans and notifying users of any changes.
  • Making interface and functionality updates as needed and informing users via email.

The administration has the right to amend the Terms of Service unilaterally without prior notice, with changes effective immediately upon posting on the official website.

8. Restrictions

PilotWizard reserves the right to limit or prohibit actions that contravene the Service’s Terms of Service, as assessed by the Service’s employees. This includes any actions perceived as violating these terms. PilotWizard may also unilaterally terminate its services at its discretion without providing an explanation.

Users are prohibited from uploading and using any email addresses or telephone numbers that have been acquired through purchase or illegally (including through specialized programs for contact information extraction).

Sending web push notifications through an API with a shared link domain that differs from the sending domain is prohibited.

Users must not store, process, or distribute via PilotWizard any information that contradicts the Anti-Spam Policy of the Service or violates U.S. law or the laws of the recipient's country.

Attempts to collect information from the Service or the company’s official website are forbidden and subject to punitive measures.

Users are prohibited from copying any part of the Service for commercial use, sharing their account access credentials, or registering an account in another person's name without their consent.

It is forbidden to use any means, including fraudulent or illegal methods, to obtain personal information of other PilotWizard customers.

Users must not send emails to recipients who have not consented to receive them or send any information that infringes on personal rights and freedoms.

PilotWizard does not provide its services to users in the Russian Federation, who are prohibited from registering, have limited access to the Service, and are not entitled to customer support. Related campaigns may be blocked without explanation.

9. Disclaimer of warranties and liability

To the fullest extent permitted by law, users assume all responsibility for losses resulting from their use of the Service. PilotWizard will not be liable for any indirect, punitive, special, or consequential damages under any circumstances, including negligence.

The Service and its materials are provided "as is" with no warranties, express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose. Since customers use PilotWizard for various purposes, we cannot guarantee it will meet all specific needs.

PilotWizard does not guarantee the accuracy of information received by recipients of campaigns. The user is responsible for the legality and accuracy of the information sent. The Service may hold users accountable if their actions are deemed contrary to the Terms of Service.

10. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions. Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts located in [Your Jurisdiction].

PilotWizard guarantees that any actions regarding Personal Data are carried out in full compliance with this Policy and the principles set forth in the EU GDPR. Updated: 01.13.2026
